        • if you visit store or if you contact us, including to make an inquiry regarding our products and services, to make a complaint, to provide feedback, to seek a refund, or to attend an event;

        • if you access our website or digital applications (for example, our App), including by the use of cookies (which are small data files transferred onto devices when a website is accessed), tags and pixels (which 'tag' devices), which may track what you view on our website or apps and also other websites that you visit. Cookies, tags and pixels may also come from third party services (such as Facebook) for the purpose of collecting data to enable website or app performance measurement and personalised advertising;
        • if you hire equipment from our stores where we supply that equipment as agent for a third party, that third party may share your hire details with us;
        • if you arrange a service or quote using a booking service provided by a third party in connection with our business, those third parties may share your details with us;
        • if you interact with BYL Building Ltd via social networking services;
        • if you subscribe to any of our mailing lists or use any of our online applications;

        • if you apply for a Trade account or any other type of credit account with BYL Building Ltd;
        • via our security cameras or other cameras installed in our stores (including in car parks, pick up areas and store entrances);
        • if you undertake any of BYL Building Ltd’ induction, safety or compliance processes;
        • if you engage, request or seek a quotation for a service from a third party that we use to provide a service to you; or

        • publicly available sources, including from Australian Government agencies such as the Australian Securities and Investments Commission, New Zealand Companies Office, internet search platforms and social media platforms, such as Facebook;
        • any person authorised to act on your behalf or authorised to provide your personal information to Bunnings;
        • credit reporting bodies and other credit providers, if you apply for a Trade account or any other type of credit account with BYL Building Ltd;
        • anyone sharing information with us for loss prevention and/or law enforcement purposes;
        • any persons you nominate, if you submit an employment application to us;

      Use and disclosure of personal information

      1. We use and disclose your personal information in connection with carrying on our business, including to provide products and services to you.
      2. BYL Building Ltd may use your personal information:
      • to charge you for products and services we provide to you and to prepare invoices and sales records for such purchases;
      • to provide advice regarding our products and services to you (or arrange for others to do so at our request);
      • to deliver our products and services to you;

      • to assist us, our service providers and Related Companies, and other third parties who we share information with for loss prevention or law enforcement purposes in investigating and preventing any potential, suspected or actual breaches of law or fraudulent activities;
      • to recruit our employees or engage contractors;
      • for any other purpose disclosed to you at the time the relevant personal information is collected; and
      • for purposes directly related to any of the above.
      1. We work with a number of third parties in carrying on our business and may disclose your personal information to:
      • third parties to facilitate the provision of products and services to you (including to facilitate repairs and customer recalls), such as to product manufacturers and suppliers, couriers and installers;
      • third parties, if you hire equipment from us which we supply as an agent for that third party;
      • marketing, advertising and promotions services providers and event organisers in connection with BYL Building Ltd’s marketing, advertising and events;
      • third parties who provide services to BYL Building Ltd in connection with our business operations, undertaking data monitoring or data analysis and data matching activities, monitoring trends in customer preferences or transactions and the operation and maintenance of our website, as well as our online services or online applications;
      • third party platforms who display advertising or content (including personalised advertising) based on your personal information or preferences (including social media platforms such as Facebook);
      • credit reporting agencies and other credit providers, to assist in assessing any application that you make to us for a Trade account or other credit account, of any nature;
      • third parties who provide other administrative and operational services to BYL Building Ltd in connection with our business, including for example financial institutions, security services providers, market research or feedback collection companies, IT service providers, payment processers and collectors, mailing houses and card manufacturers;
      • BYL Building Ltd’ professional advisers, where required to enable any such adviser to provide services to BYL Building Ltd;
      • third parties necessary to assist us in investigating and preventing any potential, suspected or actual breaches of law or fraudulent activities;
      • third parties who we share information with for loss prevention and law enforcement purposes, in investigating and preventing any potential, suspected or actual breaches of law or fraudulent activities;
      • law enforcement agencies, government agencies or other third parties, where required under or authorised by law (for example, to comply with a subpoena, a warrant or other order of a court or legal process);
      • other persons disclosed to you at the time the relevant personal information is collected; and
      • our Related Companies who may use that information to undertake data analytics and matching to enable them to better understand your requirements and preferences, and (if you interact with that business) to personalise and improve their offer to you and to offer products or providing services to you or send direct marketing to you (where you have consented to receiving offers or direct marketing from them).

      Transfer of information overseas

      1. Some of our service providers may be located overseas or may store information (including your personal information) that we provide to them overseas. We may also provide your personal information to BYL Building Ltd affiliates operating BYL Building Ltd overseas and to our Related Companies that are located overseas. Therefore, the personal information you provide to us may be held overseas. The jurisdictions in which the personal information you provide to us may be held include Australia, New Zealand and the United Kingdom.
      2. Personal information you disclose to us will only be held or processed overseas in accordance with all applicable law.

       

      Anonymity

      1. Where practicable you have the option of dealing with BYL Building Ltd anonymously or by using a pseudonym. However, if you deal with us in this manner, we may not be able to provide all of our products and services to you or interact with you in other ways set out in this policy. For example, we will not be able to deliver products to you if you do not provide us with address details for the delivery.

       

      Marketing, advertising and customer insights 

      1. As part of BYL Building Ltd’s functions and business activities and to promote the services we can provide to you, BYL Building Ltd may use, and disclose to third parties, personal information that we have collected from you or trusted third parties (including our Related Companies), for the purposes of advertising (including online behavioural advertising and website personalisation) and other direct marketing. We may engage third parties to assist us in ensuring that the marketing and advertising we provide is of interest to you. Direct marketing includes Bunnings or third parties:
      • sending to you and/or contacting you directly in relation to promotions and information about BYL Building Ltd’s products and services;
      • personalising the layout of our website to display products and services of interest to you; and
      • providing targeted advertising content to you (including through third party websites).

      We may also collect and use personal information about you from our Related Companies, such as purchase history and webpages visited on their websites and apps, to help personalise our website appearance for you and our direct marketing communications to you.

      Generally, we will provide direct marketing to you where you have requested or consented to receiving such information. You can opt out of receiving direct marketing communications from BYL Building Ltd by using the opt out link or details provided in the direct marketing communication or in the case of online advertising, by managing your preferences in digital platforms such as Google or Facebook.

The third parties we engage to assist us in marketing and advertising may use cookies (that is, small data files transferred onto devices when a website is accessed) and other technologies, such as pixels, to obtain information about your preferences when you access online platforms or websites other than the Bunnings’ website. Your preferences collected in this manner may be disclosed to us. You can manage your preferences in relation to targeted online advertising directly through digital platforms such as Google or Facebook.
      2. We may collect, use or disclose information about you in order to combine the information that we hold about you with information about you collected from or held by Related Companies, other trusted partners or from public sources. We may do this to enable us to derive insights about you. This includes being able to better understand your preferences and interests, personalise your experience, enhance the products and services you receive, and to tell you about products and services that may be of interest to you. We may also use Related Companies and trusted service providers to undertake the process of creating these consumer insights. 

       

      Security and storage

      1. BYL Building Ltd will take reasonable steps to protect the security of your personal information that we hold, including both paper and electronic records. We have security measures in place to attempt to reasonably protect personal information under our control from misuse, interference, loss, unauthorised access, modification or disclosure. For example, BYL Building Ltd seeks to ensure that personal information in paper form is held securely and personal information held electronically by or for BYL Building Ltd is held on secured servers in controlled facilities.
      2. No data transmission over the internet can be guaranteed to be secure. As a result, BYL Building Ltd cannot ensure or warrant the security of any personal information transmitted by you to BYL Building Ltd over the internet.

       

      Use and disclosure of personal information

      1. You have the right under applicable Australian or New Zealand privacy legislation to request access to, and correction of, personal information about you held by BYL Building Ltd, at no cost to you.
      2. BYL Building Ltd may require you to verify your identity at the time you request access to, or correction of, your personal information so that we can ensure your personal information is disclosed only to you.
      3. BYL Building Ltd will respond to any requests for access or correction within a reasonable time, but in any event by no later than 90 days after the date you make the request.
      4. If BYL Building Ltd refuses to provide you with access to the personal information held about you, or if BYL Building Ltd refuses to correct that information, we will provide reasons for such refusal. If you object to the refusal, you may make a complaint.

      Refund Policy:

      When returning products in stores, all products for return or exchange must be identified to the door greeter or gate keeper upon entry into the store and you'll be directed to our dedicated in-store Desk where team members will provide you with assistance.

      Change of mind returns/exchanges

      We are pleased to offer change of mind returns or exchanges.

      With a receipt or tax invoice:

      • We can provide a refund
      • All returned goods must be unused, in original packaging and in saleable condition
      • Receipts and tax invoices must be valid and intact

      All refunds will be provided back in the original tender. Cheques will be refunded as cash (once bank processing of the cheque has occurred) and credit card refunds must be processed back onto a credit card.

      Note: A credit card must be present to receive a refund.

      Without proof of purchase

      We do not accept the returns without proof of purchase

      Trade account returns/exchanges

      If you're an account customer and presenting goods for return or exchange, a copy of the original invoice must be presented in-store along with the goods to arrange an account credit.

      Commercial quantities are not generally available for change of mind returns or exchanges.

       

      Online purchases/exchanges

      Online purchases can be returned either in-store with the tax invoice or by contacting our Customer Support team via Email or phone

       

      Exceptions

      Unfortunately we cannot offer a change of mind refund or exchange on the following items:

      • Custom-made products
      • Any product/s specifically cut to size at your request
      • Toilet seats, if packaging has been opened (for health reasons)
      • Tinted paint

      These products can still be returned if they are faulty, not fit for purpose or do not match the sample or description

      Other returns/exchanges

      Our goods come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993. You’re entitled to a repair, replacement, or refund for a failure that cannot be remedied or is of substantial character, and to compensation for other reasonably foreseeable loss or damage.

      We will accept product returns and provide you with a replacement, refund or repair where:

      • The product is faulty or is not of acceptable quality; or
      • The product is not fit for its intended purpose; or
      • The product does not match its sample or description.

      We recommend you retain your receipt, as we may require proof that you purchased the product from us. Our Team Members will be able to advise you whether a refund, exchange, repair or replacement is available, and may record your proof of identification when processing a return without proof of purchase. 

       Shipping Policy:

      Delivery (if applicable)

      1. Where the Product is able to be delivered, delivery options are listed on each Product's Product Page.
        b. The option selected by you and the applicable estimated delivery times and delivery charges will be shown in your Checkout Summary. BYL will use reasonable endeavours to deliver Products within the time frame shown.
        c. You will be notified via email once your Products have been dispatched.
        d. If the Product has not been delivered within a reasonable time (depending on the nature of the Product and the delivery address), please contact us if you wish to cancel your order for that Product and request a refund.
        e. You must ensure there is clear and safe access for delivery. Please ensure there is a person present at the delivery premises who is authorised by you to accept delivery. If there is not, you authorise and acknowledge that our delivery service providers will carry out delivery of the Product(s) by leaving the Product(s) at your door step or at the ground level of the delivery premises.Delivery does not include installation or moving of products inside your premises.
        f. Risk in the Products passes to you upon delivery to your nominated delivery address, and title passes upon payment for the Products in full.

      BYL Building Ltd (BYL, we, us, our) is pleased to offer you the opportunity to buy and receive goods and services (Products) from us through the BYL website (Website) and store on the basis of the following terms:

      2. In respect of each Product listed in your Checkout Summary, your order is an offer from you to BYL to buy that Product from us.
        b. BYL will be bound to supply you the Product (subject to its cancellation rights in clause 7 below) once payment has been processed and BYL has sent you an email order confirmation.
        c. BYL reserves the right to accept or reject your order in in full or part and for any reason including without limitation, unavailability of product; an error in the price, image or the product description; or error in your order.
        d. You warrant that all information and data provided by you in your order is accurate, complete and up to date. You will promptly notify BYL if there is any change to this information or data.
        e. You acknowledge BYL, where permitted by law, reserves the right to limit the sale of products to reasonable or normal household quantities.
        f. All accepted orders supersede all previous quotes/estimates.
      3. Information about Products

      Due to photographic and screen limitations associated with the representation of Products, some actual goods may differ to a small extent in visual appearance (for example in colour) from the way they appear on the Website.

      2. You must pay for all online purchases at the time of online checkout, prior to order confirmation, in accordance with one of the payment methods offered on the Website. We currently accept payment by Visa or Mastercard. Where we cannot fulfil an order, a refund will be provided under clause 8.
        b. The prices of Products, and any delivery or other charges, shown are in New Zealand dollars.
        c. You acknowledge the price for Products excludes delivery or shipping charges. Delivery or shipping charges will be payable on Products purchased and may vary depending on the number of Products to be purchased, the size or shape of the Products and your residential address.
        d. BYL may vary the prices on this Website at any time, and prices are subject to change until you have paid for the Products in full.

       

      1. Click & Collect (if applicable)
      2. There may be an option to collect Products from a BYL’s store near you. If Products are being collected, please collect them within 14 days after BYL informs you that they are ready for collection. If you do not, then unless you make arrangements with us for late collection, Bunnings will assume you have cancelled your order. This means BYL may re-sell the Product, and you may be required to pay a re-stocking fee or, in the case of specially ordered or custom-made product, forfeit any deposit/payment you have made. As part of the collection process, BYL may require you to book a collection time and to verify your identity upon collection.
      3. Warranties and liability

      a.All Products come with consumer guarantees that cannot be excluded under New Zealand consumer laws. You may be entitled to a replacement, repair or refund if a Product is faulty.

      1. Products may contain warranty documents on or inside the packaging provided by the manufacturer or distributor of the Product. Unless clearly expressed otherwise, any such warranty is not given by BYL.
      2. All other warranties and representations are excluded, except those which are non-excludable in law. Where Products supplied are not of a kind ordinarily acquired for personal, domestic and household use (for example, commercial products) or the Products are purchased for business use, you agree the protections provided by New Zealand consumer laws do not apply, including, without limitation, the Consumer Guarantees Act.
      3. To assist BYL in resolving any problems you may experience, please inspect the Products upon taking delivery and report any shortage, discrepancy, defect, wrong specification or similar problem to BYL as soon as you become aware of it.
      4. Cancellation by BYL
      5. You acknowledge that in some cases it may not be possible for BYL to fulfil or meet your order and, therefore, BYL may need to reject and cancel your order you have made for a Product.
      6. BYL may cancel any order (in full or part) where: (i) you are in breach of your payment obligations; (ii) BYL reasonably suspects that you are purchasing goods for the purposes of resale or resupply; (iii) BYL becomes aware after order confirmation that the good is out of stock; (iv) there has been a genuine pricing or product description error; or (v) where the transaction is suspected of being the subject of credit card or payment-related fraud. BYL will refund any amount already paid in respect of any cancelled order. In the case of part cancellation of an order, a refund will be provided on the amount paid that relates to the cancelled portion of the order.

      9. Gift cards and exchange vouchers
      10. BYL gift cards are subject to additional terms and conditions. BYL gift cards and exchange vouchers may not be used to purchase Products on the Website.
      11. Privacy
      12. BYL collects your personal information to allow us to supply you with Products or services.
      13. By placing an order through this Website, you consent to BYL collecting your personal information (including your name, contact details and delivery address) and providing it to third parties (including suppliers and delivery contractors) for the purpose of fulfilling and delivering your order.
      14. Inconsistency
      15. These Terms of Sale, together with BYL policies available on the Website (including our returns and privacy policies) apply to the exclusion of all other terms. In the event of any inconsistency between those documents, these Terms of Sale will take precedence.
